Oakwood Teen Gets Probation in Rape Involving 12-Year-Old ; He Will Undergo a Sex Offender Treatment Program and Can't Have Unsupervised Contact with Girls Under 15.

DAYTON -- A 15-yearold Oakwood boy who admitted to raping a 12- year-old girl was placed on probation and ordered to complete a sexual offender treatment program Wednesday by a Montgomery County juvenile judge.

"Obviously you need to take this very seriously," Judge Tony Capizzi said after listing numerous requirements and prohibitions the boy must follow to avoid serving time at a juvenile facility. "There is no wrist-slapping." The boy is one of three friends accused of raping the girl during repeated incidents last summer. A fourth boy is charged in a single incident that did not involve the other three boys. None of the boys was charged with the portion of the rape statute that deals with forcible encounters. However, the statute also says a child under 13 cannot legally consent to sex. The girl was 12 at the times of the encounters.
